1. General

1.1 This page and all pages that refer to Eight Monkey’s AB (Eight Monkey’s) general terms and conditions (the “Terms”) apply when you as a consumer (“you”) place an order via www.eightmonkeys.com and associated pages, (the “Website”). The agreement is entered into between you and Eight Monkey’s AB, 559050-6860. Detailed contact details and other information about Eight Monkey’s can be found on the website. By using the website, you show that you agree to these general terms and conditions and if you do not agree or accept the terms, you should stop using the site.
1.2 Eight Monkey’s reserves the right for final sales and any image and writing errors on the Website, such as errors in product description or technical specification, incorrect prices and price adjustments (such as changed prices from suppliers or currency changes) or incorrect information regarding whether an item is in stock. Eight Monkey’s has the right to correct any such errors and to change or update the information at any time. If an incorrect price has been quoted for an item you have ordered, Eight Monkey’s will of course notify you of this and await your acceptance of the corrected price before Eight Monkey’s proceeds with the order. All pictorial information on the Website is for illustrative purposes only. Such illustrations cannot be guaranteed to represent the number of items you receive or the exact appearance, features or origin of the item. Eight Monkey’s is not responsible for any information on the website that comes from a third party.
1.3 The Website, and all content on it, is owned by Eight Monkey’s or its licensors. The information is protected by, among other things, intellectual property and marketing laws. This means that trademarks, company names, product names, images and graphics, design, layout and information about goods, services and other content may not be copied or used without the written consent of Eight Monkeys.
1.4 To be able to shop with an invoice or installment as a means of payment, you must be at least 18 years old. Eight Monkey’s reserves the right to refuse or change your order in individual cases (for example, if you have provided incorrect personal data and/or have payment remarks).

2. Orders

2.1 In order to make a purchase via the website, you must accept the terms. By accepting the terms and conditions, you agree to comply with the terms and conditions in their entirety, and agree that you have read the information on personal data and consent to the use of personal data and cookies in accordance with Eight Monkey’s Privacy Policy.
2.2 A purchase agreement is only concluded when Eight Monkey’s has confirmed your order and you have received an order confirmation from Eight Monkey’s by e-mail. Eight Monkey’s encourages you to save this order confirmation for possible contacts with Eight Monkey’s customer service. You can withdraw your order until it has been confirmed by Eight Monkey’s. If the order is withdrawn, Eight Monkey’s will refund any payments made by you or your debit or credit card companies in relation to the order.

3. Prices, charges and payment

3.1 Prices are quoted in local currency and are inclusive of VAT. Prices do not include any payment or shipping fees, which are indicated separately at checkout.
3.2 Eight Monkey’s has the right to take payment already in connection with the order, unless invoice payment or other similar payment method is chosen by you and approved by Eight Monkey’s. For invoice payment or partial payment, Eight Monkey’s or its partners may make a credit check. In such cases, you will be informed of this. Eight Monkey’s reserves the right to not always offer all payment methods, or to change payment methods if the one you have chosen for some reason does not work at the time of purchase. Please note that any restrictions on payment options are stated on the Website.

4. Promotions and offers

4.1. Eight Monkey’s may from time to time offer campaigns on the website that may have more favorable terms than what is stated in these terms and conditions, e.g. regarding payment or extended right of withdrawal. These more favorable conditions apply as long as the campaign is active and for the specific goods specified by Eight Monkey’s in connection with the campaign. Eight Monkey’s reserves the right to withdraw such promotions at any time. Upon termination or withdrawal of a promotion, these Terms and Conditions will apply without modification. Offers on specific items on the website are valid for a limited time and while stocks last.

5. Delivery and transport

5.1. Eight Monkey’s aims to dispatch your order within one to two working days of receiving your order confirmation. Please note that it may take longer in case of sales, other unexpected events or depending on product availability.
5.2. You will receive delivery information by email once your order has been shipped from us with an estimated time of delivery.
5.3 Depending on the country you are in, there are different shipping methods. The cost of shipping depends on the shipping method you choose. You will find different options for your country at checkout.
5.4. For orders with a value exceeding 1000 SEK, no shipping cost will be charged for the standard shipping option, for orders with a value lower than 1000 SEK a shipping cost will be charged which varies depending on the chosen shipping method. Any shipping cost will be charged in addition to the price of your product(s) and will be clearly shown in the total cost at checkout.
5.5. You must provide accurate and complete address information in your order as we cannot guarantee that it can be changed after you have completed your purchase. The customer is solely responsible for any delivery errors due to lack of information or errors in the delivery address in the order.
5.6 If parcels are to be redeemed, you must do so within the time specified in the notification. Parcels should normally be collected in person with valid identification and order number. You will always receive a notification showing where and when parcels are to be collected. Notification can be made by e-mail, regular mail and, if you have provided a mobile phone number, also by phone call or SMS. If you do not pick up the package, Eight Monkey’s has the right to charge you a fee of SEK 149.
5.7 Our carriers will make every effort to deliver your order within the promised delivery time. However, delays are sometimes unavoidable. If you have not received your package within the promised delivery time, please contact our Customer Service. If your order is not delivered within the published timeframe, we will inform you as soon as possible, if possible, of the reason for the delay and of a new delivery time. If the delivery time has been of significant importance, you have the right to cancel the order free of charge.

6. Returns and refunds

6.1 As a consumer, you always have a 14-day right for a refund but Eight Monkey’s offers 30 days refund rights from the day you have received your order. The product must be in its original condition and must not be used or washed. All labels must remain on the product.
6.2. If you want to return or exchange a product, follow the instructions included in the package or on the Eight Monkey’s website. In order for Eight Monkey’s to handle the return, the return form must be completed correctly.
6.3 If you return an item, it is important that you save your receipt of the order as you as a customer are responsible for the goods until they reach our warehouse. If you are missing a return label, you can get a new one by contacting our customer service.
6.4 When you return or exchange an item, Eight Monkey’s will refund the amount you paid for the item, including delivery costs. Exceptions apply to any additional delivery costs resulting from your choice of delivery method other than the standard delivery offered by Eight Monkey’s. When returning part of an order, any delivery costs are not refunded.
6.5 On the amount to be refunded, Eight Monkey’s has the right to deduct a sum corresponding to the depreciation of the goods compared to the original value of the goods, if and to the extent that such depreciation is due to the fact that you have used the goods to a greater extent than is necessary to determine its characteristics or function.
6.6 When exercising the right of withdrawal or exchange, you pay the return shipping and are responsible for the condition of the goods after you have received the goods and during the return shipping. A prepaid return shipping label is included in the package to be used for the return. No return shipping cost will therefore have to be paid at the time of submission, but the cost of the return is regulated via a fee deducted from the refund amount.
6.7. Eight Monkey’s will refund the amount as soon as possible, but no later than 14 days from the date we received your return and send you a return confirmation by email. The refund will be made to you via the payment option you chose when you purchased the item, unless otherwise agreed or there are obstacles to such a refund.

7. Warranty and complaints

7.1 Some of Eight Monkey’s goods may be covered by a warranty. Information about any warranty period and specific warranty conditions for each item can be found on the website or in these terms and conditions. The warranty for goods only covers original manufacturing defects, and thus not defects that arise during or after an in-house change in the function and appearance of the goods, Your order confirmation applies as proof of warranty.
7.2 The right of complaint covers goods that are defective according to current consumer protection legislation. If you discover that the product is defective when you receive your order, you should contact Eight Monkey’s as soon as defects are discovered. You have a 3-year warranty on goods purchased on the website.
7.3. Eight Monkey’s is responsible for return shipping for approved complaints.
7.4. When the claimed product is returned and the claim is approved, Eight Monkey’s will compensate you in accordance with applicable consumer protection legislation. Eight Monkey’s strives to do this within 30 days of Eight Monkey’s receiving the complaint, but it may take longer depending on the nature of the product. Eight Monkey’s reserves the right to deny the complaint if it turns out that the product is not defective according to applicable consumer protection legislation. 8. Links

8.1 Eight Monkey’s may link to other websites that are outside Eight Monkey’s control, and websites outside Eight Monkeys’s control may link to Eight Monkey’s website. Although Eight Monkey’s tries to ensure that Eight Monkey’s only links to sites that share Eight Monkey’s privacy and security practices as set forth in the Privacy Policy, Eight Monkey’s is not responsible for the protection or privacy of any information or personal data you provide on other sites. You should exercise caution and read the privacy policy of the website in question.

9. Force majeure

9.1 Eight Monkey’s is not responsible for delays caused by circumstances that Eight Monkey’s could not control, such as general labor disputes, war, fire, lightning, terrorist attacks, changes in government regulations, technical problems, errors in electricity / telephone / data connections or other communications and errors or delays in services from subcontractors due to circumstances listed here. These circumstances shall constitute grounds for exemption from damages and other penalties. Should such a situation arise, Eight Monkey’s will inform you at the beginning and end of the time of the situation in question. If the circumstance has lasted longer than two months, both you and Eight Monkey’s have the right to cancel the purchase with immediate effect.
